Terms and Conditions of Carriage of Passengers

ARTICLE 1 - DEFINITIONS
  • AGENCIES: The ticket sales agency authorized by the Carrier to represent it in the sale of passenger transportation services.
  • ATHENS CONVENTION: Means the Athens Convention relating to the Carriage of Passenger and their Baggage by Sea (1974) as amended by the 1990 Protocol and as may be modified from time to time and to the extent ratified and adopted by the Government of the United Arab Emirates.
  • CARRIER: The company holding the license for carrying passengers on Water Transport Services in Abu Dhabi is Jalboot Marine Network LLC, Mezzanine Floor, Abu Dhabi Mall P.O. Box 55345, Abu Dhabi, United Arab Emirates as the operator of the vessel and its employees and agents.
  • CARRIER'S TERMS AND CONDITIONS: The terms and conditions published or produced by the Carrier which regulates the carriage of Passengers and/or baggage and which is valid on the date of issuance of the ticket and includes the fare in force at the time.
  • DAYS: Refers to the seven calendar days of the week including bank holidays, with the proviso that in terms of notification, the day on which a notification is received or in terms of determining its period of effectiveness, the issue date of the Ticket or the day of commencement of transportation is not taken into consideration.
  • DAMAGE: Includes death, injury, delay, loss, damage, partial damage or other harm arising in connection with the carriage service during the course of carriage by the Carrier or in connection with other services related to the carriage.
  • FARES: The fee paid for the right to travel on a Boat Trip.
  • LUGGAGE/BAGGAGE: The objects, materials and other personal belongings necessary for the passenger's short term needs during the Trip. It includes all property accompanying and /or carried by the Passenger both at the places of departure and destination and on board the vessel. In no case may baggage exceed 10 kg dimensions of 55cmx40cmx20cm max per passenger.
  • PROTECTED PERSON: Means any employee or agent of the carrier in performance of the contract of carriage and their respective employees or agents.
  • PASSENGER: The persons, with the exception of the operation and management personnel of the ferries, who are or are to be transported, subject to the consent of the carrier, via Boat service, fast ferries and conventional ferries. Includes all persons whatsoever including infants and unborn children travelling in terms of any contract of conveyance on the vessel and any person embarking on or proceeding on a cruise on the vessel whether a fare paying passenger or otherwise.
  • PRICING: Carrier is not bound to applying a fixed fare, and the fee schedule varies depending on the proximity of departure, on a particular day or at particular times and on the number of vacancies on the Boat/Ferry. The fares are subject to change without notice.
  • TRIP: The act of transportation on the Carrier's lines on a particular day and at a particular time from one point to another.
  • TRANSACTION FEE: The fee added to the ticket price for the sales service of any Boat Trip. The added fee may vary depending on the sales channel.
  • TICKET: The transport document issued by or on behalf of the Carrier marked with the heading "passenger ticket", which refers to these Terms and Conditions of Carriage of Passengers and warnings.
  • VESSEL: means the vessel on which the Passenger is to be carried pursuant to the contract of carriage.
  • Throughout this document any reference to the male gender shall be deemed to include the female gender.
ARTICLE 2 - SCOPE
  • The carrier's obligations to the passenger for the carriage of the passenger and his property are regulated solely by these terms and conditions, and no waiver of these terms and conditions or admission of representations, warranties, promises, undertakings, and the like given or made or on behalf of the carrier and all other understandings and agreements entered into between the passenger and the carrier, shall be of no force or effect whatsoever, in so far as such representations, warranties, promises, understandings and agreements are at variance with these terms and conditions.
  • Purchase of a ticket or tickets singly or in bulk from the carrier or any of its agents shall be deemed and treated as a full and unconditional implied acceptance by such passenger or passengers of all the terms and conditions contained in this "Terms and Conditions of Carriage of Passengers" and the passenger shall not be allowed to plead ignorance of the same.
  • GENERAL
    The contract of carriage is made between the Carrier and the Passenger and is expressly subject to: The Athens Convention
    The Athens Convention in most cases limits the Carrier's liability for death or personal injury or loss of or damage to luggage and makes special provision for valuables. The Athens Convention presumes that luggage has been delivered undamaged unless written notice given to the Carrier.
    The application of the Athens convention will be to the extent that it is in conformity with and not in contradiction to the Laws of the United Arab Emirates.
    Scope of Application:
    The contract of carriage, including these conditions, shall apply from the time the Passengers with or without any luggage embarks on the Carrier's vessel, throughout the period on board the Carrier's vessel, to the Passenger disembarking from the Carrier's vessel, but such embarkation and disembarkation shall be deemed to include any necessary transfer by sea to and/or from the Carrier's vessel.
    • These Terms and Conditions of Carriage of Passengers, which are hereby incorporated therein,
    • The provisions of any legislation compulsory and applicable to the carriage of the Passenger.
    • The Athens Convention relating to the Carriage of Passengers and their luggage by Sea 1974 ("The Athens Convention") which, so far as not otherwise compulsorily applicable to the carriage of the Passenger, is hereby incorporated into and forms part of these conditions of carriage.
    • In the case of apparent damage, before or at the time of disembarkation or redelivery.
    • In the case of damage, which is not apparent, or of loss, within 15 days from the date of disembarkation or redelivery of from the time when such redelivery should have taken place, luggage is of the responsibility of the passenger at all times. Luggage is to be kept with passenger/or placed in luggage department provided on the ship. Any term in those conditions of carriage [with the exception of clause 1], which is inconsistent with or repugnant to any extent to any applicable legislation or to the Athens Convention, shall be void to that extent but no further. Nothing in these conditions of carriage shall operate to limit or deprive the Carrier of any statutory protection of exemption from, or limitation of, liability.
    • FARE PASSENGERS, REDUCED PRICE and FREE TRAVEL
      The Carriage Regulations specified here apply to the carriage of all passengers in the Emirates of Abu Dhabi, UAE by the Carrier for a fare.
      Unless any other regulations are introduced by the Carrier concerning carriage regulations, agreements, tickets and other free passes, the General Conditions herein also apply to any carriage based on discounts or free travel.
    • LAWS TAKE PRECEDENCE OVER THE CARRIER'S RULES
      In the event that any condition referred to herein or contained in these Carrier's Rules is contrary to applicable laws, government rulings, orders or requests that cannot be renounced by the parties, any conditions herein that are contrary to the law cannot be applied. The invalidity of any ONE condition does not affect the validity of the other conditions.
ARTICLE 3 - TICKET
  • VALIDITY
    The Passenger's ticket is valid only for the trip for which it is sold. All times are indicated in local time. The Carrier shall not be liable for any late arrival and/or sailing of the vessel at either the place of departure or at the place of destination. Any ticket purchased is only valid for the trip specified on it and does not constitute a right to travel on any other trip; expired tickets are invalid. It is the passenger's responsibility to check that the details on the ticket are correct; any objections presented subsequently are invalid.
  • TICKET AS PRIMA FACIE EVIDENCE OF CONTRACT OF CARRIAGE
    Until proved otherwise the Passenger Ticket serves as prima facie evidence of a carriage agreement between the carrier and the passenger in possession of the ticket. The contract conditions listed on the ticket are a summary of some of the Carriage Conditions herein.
  • PRESENTING THE TICKET
    A passenger who fails to present a valid ticket as issued by the carrier according to the Carriage Conditions is not entitled to claim any rights. The Passenger is not entitled to carriage in the event that the presented ticket is ripped or torn, or has been modified by anyone other than the Carrier or its authorized agent.
  • LOSS OF TICKETS
    In the event of loss of the ticket, Carrier cannot issue a replacement. The passenger may only travel upon purchase of a new ticket for the relevant trip.
  • TICKETS ARE NON-TRANSFERABLE
    A passenger ticket issued in a person's name may not be transferred or resold. If a ticket is presented for carriage or refund by anyone other than the person entitled by that ticket to travel, as long as the carrier carries or refunds the person who has presented that ticket in good faith, it is not liable to the person entitled to travel with that ticket.
  • TICKET PRICES AT DIFFERENT SALES CHANNELS
    Tickets for Water transport services by the Carrier are sold through different sales channels. In the event that a ticket offered at a reduced price is acquired at a higher price through a different channel as a consequence of temporary problems or the Transaction fees, the difference between the reduced price and the sales price cannot be claimed.
  • TICKETS WITH NUMBERED AND UNNUMBERED SEATS ON SPECIFIC ROUTES
    On some services, the carrier specifies whether the seats are numbered or unnumbered on specific lines or trips. The carrier reserves the right to change a trip with numbered seats into a trip with unnumbered seats.
  • REDUCED PRICE TICKETS
    The carrier shall specify which persons are eligible to purchase reduced price tickets. Passengers in possession of reduced price tickets must show their discount pass at the Terminal or when requested to do so by the ferry staff during the course of the journey. Failure to do so will result in the passenger being charged twice the amount of the difference between the full price and the reduced price.
  • TRAVEL WITHOUT A TICKET (ILLEGAL TRIP)
    Passengers on any Carrier's Trip, who are discovered to be travelling without a ticket will be charged twice the ticket price and upon failure to pay will be prosecuted as per the Laws of the United Arab Emirates.
  • CARRIAGE OF DISABLED PASSENGERS
    The Carrier needs to be informed about the disabled passenger at the time of reservation/purchase of the ticket, so that necessary arrangements can be made by the carrier and the same will be entered in the ticket. If the same is not entered in the ticket, the carrier shall not be held liable for the inconvenience.
  • TRIP CANCELLATION AND CONDITIONS FOR REFUNDS AND CHANGES
    Following the purchase of a ticket for any services by the Carrier, in the event that trip is cancelled for reasons beyond the control of the Carrier (such as adverse sea or weather conditions, etc.), the ticket price will be refunded to the passenger in full; in the event that a ticket is subsequently purchased for an alternative date, any potential price difference between the fare for the cancelled trip and that of the newly purchased ticket cannot be claimed.
  • POWER TO REFUSE EMBARKATION
    The carrier may, without giving any reason thereof, refuse to allow any passenger to embark upon the vessel at any time prior to the sailing of the vessel and shall in this case return the passage money paid by such passenger and such passenger shall have no claim whatsoever against the carrier in respect of such refusal or cancellation.
ARTICLE 4 - NAMED PASSENGER/AGENT OF OTHER PASSENGERS
Where one ticket or document of contract or undertaking for conveyance upon the vessel is issued in respect of a number of passengers, the passenger whose name appears on such ticket or document and/or who purchases the ticket or otherwise deals with the carrier or its agents when the contract is made and/or at any other time (hereinafter referred to as "the named passenger") contracts and/or deals with the carrier as agent for all other passengers in respect of whom the said ticket or document is issued and is entered into with the intent and so that all other passengers are bound by these terms and conditions and/or such dealings and the named passenger warrants without reservation that he has the authority so to contract and/or deal with the company or its agents on behalf of all such other passengers and bind them as aforesaid. The named passenger undertakes to indemnify the carrier, its agents, managers, passage brokers, employees and all other persons dealing with the booking of passage on or associated with the operation of the vessel and keep them indemnified against all claims of whatever nature which may be brought against the carrier, its agents, managers, passage brokers, employees or persons associated with booking of conveyance or the operation of the vessel by any such other passenger or by the representatives or dependents, executors or assigns of any such passenger by virtue of a breach of such warranty
ARTICLE 5 - TICKET CANCELLATION AND FORFEITURE OF FARES - REFUND
  • The amount shown on any ticket or in any correspondence or other communication with the passenger represents the Fare in force at the due date of issue of such ticket.
  • Upon the cancellation of any ticket by the Passenger, the Refund policy is as follows:
    • Any cancellation received within thirty one (31) days or more from the date of sailing - Passenger forfeit ten percent (10%) of the full Fare raised by the company.
    • From fifteen days (15) to thirty days (30) prior to sailing - Passenger forfeit fifty percent (50%) of full fare raised by the company.
    • Fourteen (14) days or less from the date of sailing - Passenger forfeit the full fare raised by the company.
  • All Refund requests needs to be processed through the sale channel/agent through which the Passenger purchased the ticket.
  • Any and all the Transaction fees, if any, collected shall not be refunded and the refund percentage shall be calculated on the ticket fare excluding the transaction fees.
  • All cash refunds for tickets will only be available at Jalboot head office.
ARTICLE 6 - VESSEL'S REGULATIONS
  • Passengers must comply with any regulations which the carrier or the Captain in its or his sole discretion, may at any time consider necessary for the general good, comfort and safety of the vessel, its equipment and all persons on board the vessel.
  • From the time of embarkation to the time of disembarkation the Captain is in complete control of the vessel and all Passengers and property on board the vessel, and passengers are required to carry out all instructions and requirements of the Captain without reservation.
  • The onus is upon the passenger to ensure the whereabouts of life jackets or other life saving devices on board the Vessel together with the positioning of all fire extinguishers and other safety devices on such vessel and the onus shall further be on the passengers to familiarize themselves with the use of such devices.
ARTICLE 7 - BOARDING AND DISEMBARKING PROCEDURES
  • The passenger shall proceed to the area identified by the Carrier for the boarding procedure in a manner which is compatible with the carrier's departure and boarding procedures, and shall not arrive at the boarding point any later than the time specified by the carrier. Failure on the part of the passenger to be at the departure terminal at the time specified by the Carrier (as specified in the Carrier's website) will result in the loss of the right to travel if crowded conditions or other circumstances at the terminal prevent the passenger from travelling; the loss of this right may not be contested.
  • It is dangerous and prohibited for passengers to board or disembark before the landing ramp has been fully lowered and the ferry staff have given the go-ahead for boarding or disembarking and before the necessary safety precautions have been taken.
ARTICLE 8 - DANGEROUS GOODS
  • The passenger warrants that no goods or article brought on board by him, whether amongst his property or otherwise, are prohibited by any Government or applicable law or regulation or are of a dangerous nature or contain any inherent vice and that he shall be solely and absolutely responsible for and will indemnify the carrier against any detention of the vessel and any penalties, fines, expenses, loss, damage, or liability whatsoever kind resulting from a breach of this warranty.
  • All passengers will at all times whilst on board or in the vicinity of the vessel or any of its tenders or facilities provided by or in association with the vessel, conduct themselves in an orderly and sober manner having due regard to the convenience, safety and comfort of the other passengers, crew and the vessel. If in the reasonable opinion of the carrier or the Captain, any passenger is in breach of, or is likely to be in breach, of this clause, the carrier or the Captain may refuse the passenger permission to board the vessel at any place or may discharge the passenger and his property at any place, in which event or events the passenger shall not be entitled to any refund of passage money or fares or be entitled to claim any ages from the carrier arising from such refusal of permission to board or discharge, as the case may be.
ARTICLE 9 - REFUSAL AND RESTRICTION OF CARRIAGE
  • RIGHT TO REFUSE CARRIAGE

    The Carrier may, for security reasons or at its discretion, refuse the right of carriage of Passengers or Passenger Baggage for the following and similar reasons:
    • Passenger misconduct, age or mental or physical state,
    • If the passenger requires special assistance from the Carrier,
    • If they cause a disturbance to or provoke complaints from other passengers or
    • if they present any kind of risk or danger to others or to their property,
    • If they are under the influence of any narcotic or banned substance or drug or under the influence of alcohol.
    • If the passenger smokes during the journey in spite of being instructed by staff not to do so.
    • If the passenger's failure to observe the carrier's instructions requires such a refusal to be made,
    • If the passenger refuses security checks
    • If the Ticket presented by the passenger has been acquired illegally, or if it has been issued or purchased from someone other than the Carrier or its authorized agent, or if it is reported as being stolen or lost, or if it is a forged ticket, or if someone other than the Carrier or its authorised agent has modified it or if it is r(in which case the Carrier reserves the right to confiscate such a Ticket) or if the person presenting the Ticket is unable to demonstrate that he/she is the person named in the section "Passenger Name" (in which case the Carrier reserves the right to confiscate such a Ticket).
    • Any flammable or explosive gases, such as LPG or CNG, are not accepted on ferries.
    • The carrier reserves the right to refuse carriage to passengers who arrive at the boarding point in an inebriated state or while under the influence of drugs to the extent that they could adversely affect the safety or comfort of other passengers or disrupt the journey. In such an event the ticket price will not be refunded.
    • The Carrier shall not pay compensation to Passengers who have been refused carriage.
  • CARRIAGE RESTRICTIONS
    • Admission for carriage of unaccompanied children, passengers requiring special assistance, pregnant women or sick people may be subject to prior agreement and arrangement with the carrier, as per the Carriage Terms and Conditions. During the carriage of such passengers, the carrier may not in any way be held liable for any deterioration in the health of the passengers in question.
    • Children under the age of 16 (sixteen) may not travel unless accompanied by an adult. In the event that they do travel unaccompanied, Carrier cannot be held liable for any damages or harm that may be incurred.
ARTICLE 10 - BAGGAGE
  • FREE BAGGAGE ALLOWANCE
    • The objects, materials and other personal belongings necessary for the passenger's short term needs during the Trip. It includes all property accompanying and /or carried by the Passenger both at the terminals at the places of departure and destination and on board the vessel. In no case the baggage shall not exceed 55cmx40cmx20cm in dimensions and 10kg in weight
    • Wheelchairs of physically disabled passengers are accepted on board free of charge in addition to the hand luggage stated above.
  • ITEMS NOT ACCEPTED AS BAGGAGE
    • The following items may not be carried in Passenger Baggage:
      • Articles not matching the definition for baggage,
      • Dangerous materials defined as materials prohibited in maritime transport, materials with characteristics that may endanger sea buses, ferries, the carrier staff or passengers or their property,
    • Materials considered to be prohibited in maritime transportation, Fragile or damageable materials or materials deemed unsuitable for carriage at the discretion of the Carrier on account of their weight or dimension, live animals, firearms and ammunition.
    • The carrier cannot be held liable for any damages to the Baggage.
  • RIGHT OF REFUSAL TO CARRY BAGGAGE
    The Carrier may refuse to carry as baggage those items that have been identified as being prohibited and similar items and may also refuse carriage of items that are not detected initially but are detected when they are handled.
  • THE RIGHT TO SEARCH
    • For safety and security reasons the carrier may request permission from the passenger to search his person and baggage and may carry out, or have the search carried out, in the absence of the passenger.
    • In the event that the passenger does not comply with this request, the Carrier may refuse to carry the passenger and/or baggage.
  • CARRIAGE OF ANIMALS - Special Exception
    Guide dogs accompanying vision- or hearing-impaired passengers shall be allowed to accompany the Passenger, subject to the Carrier attendant's advice.
ARTICLE 11 - DELAY AND CARRIAGE CANCELLATIONS
  • DELAY
    It is possible that trips may be delayed or cancelled on account of circumstances beyond the Carrier's control. Carrier cannot be held liable for any pecuniary or non-pecuniary damages arising from such an event.
  • PLANNED OR UNPLANNED CARRIAGE CHANGES AND TRIP CANCELLATIONS
    • In the event that due to force majeure the boat docks at a destination other than that specified, the carrier reserves the right to choose between procuring alternative means of transport and carrying the passengers to the destination specified on the ticket or refunding the price difference between the destination at which the passengers disembark and that specified on the ticket.
    • The Carrier reserves the right to change the type of Boat/ship assigned to any Trip without prior notice.
  • TRIP CANCELLATION
    Force majeure (technical difficulties, acts of nature, adverse weather and sea conditions) may result in delays and trip cancellations. Carrier cannot be held liable for any pecuniary or non-pecuniary damages arising from such an event.
ARTICLE 12 - MISCONDUCT ON THE BOAT/FERRY
  • In the event that a passenger behaves in a manner which endangers the ship or any individual or property or which impedes any member of the transportation staff from performing his/her duties or fails to comply with the requests of the transportation staff or gives rise to reasonable complaints from other passengers, the carrier may take the measures it deems appropriate to prevent the continuation of the misconduct in question, including restraining the passenger.
  • Passengers must not leave their seats during departure and docking manoeuvres. Passengers must observe any warnings announced by the public address system or displayed on screen during the course of the journey. The carrier shall not be liable for any injuries or damages arising from failure to comply with these regulations.
  • Passengers are not permitted under any circumstances to smoke cigarettes or any other form of tobacco or to consume or use drugs or banned substances or alcohol on any ferry line.
ARTICLE 13 - SECURITY CHECKS
  • Passengers are required to observe all security measures and checks applied by the carrier.
ARTICLE 14 - LIABILITY FOR DAMAGES
  • The carrier shall only be liable for damages incurred to a passenger or baggage in the event that such damages are due to the fault of the carrier. In the event that the passenger is guilty of contributory negligence, the carrier's liability may be reduced or disregarded in accordance with legal provisions.
  • The Carrier is only liable for damages incurred during carriage if performed by themselves. It shall not be liable for carriage performed by another carrier.
  • As long as the carrier is not proven to be guilty of gross negligence, the carrier shall not be liable for damages incurred to unregistered baggage. In the event that a passenger is guilty of contributory negligence, the carrier's liability shall be subject to the provisions of the applicable legislation governing contributory negligence.
  • Carrier liability is limited to the actual proven amount of damages not exceeding the liability limit. The Carrier shall not be liable for any other damages that may occur indirectly.
  • The carrier is not liable for any injuries caused to the passenger on account of an object contained inside passenger baggage or for any damage caused to the passenger baggage. In the event that the property of any passenger causes damage to any person or to any person's property or to the carrier's property, that passenger shall be liable for indemnifying the carrier for all damages and expenses incurred.
  • The Carrier shall not be liable for any damage caused to fragile or damageable materials, money, jewellery, precious metals, silver, deeds or other commercially valuable documents, passports or other identification documents or copies of the same carried inside the baggage.
  • If a passenger is in danger or at risk on account of age, mental or physical state, the carrier shall not be liable for any illness, injury or disability or resulting death of a passenger as a consequence of the above situation in the event that the health of said passenger deteriorates during carriage.
  • Laws restricting the carrier's liability or exempting it are equally applicable to the carrier's representatives, agencies, personnel, crew and the person steering the carrier's vessel and his/her representatives, personnel and crew. The total sum of indemnification that can be claimed from the carrier and its representatives, personnel and crew cannot exceed the upper limit of the carrier's liability.
  • In the event that the carrier demonstrates that the death or injury was the cause of the damage or demonstrates the existence of concurrent negligence, the carrier shall be partly or wholly released from liability under applicable law.
  • If the damage or injury is caused to the passenger on account of the passenger disobeying or committing any breach of the terms of carriage specified herein whether willfully or inadvertently, or directly or indirectly, then the carrier, its agents or personnel shall not be liable or responsible for the same.
ARTICLE 15 - CLAIMS ARISING FROM CUSTOMER COMPLAINTS, TIME LIMITATION AND LIMITATION OF LIABILITY
  • SUBMISSION OF COMPLAINTS
    • Customers should submit their complaints within 7 days of the incident that gave rise to their grievance, together with evidence, if it exists, (tickets, etc.) to one of the following channels. The message will be dealt with within 15 days of receipt.

      • Request and Complaint Forms: Customers may submit their complaints by completing a request and complaint form which is available at the office of the Carrier.
  • EXCLUSION OF LIABILITY
    • The carrier shall not be liable for any loss of life or for any other loss, injury, delay, inconvenience, deficiency in service, expense or damage whatsoever suffered by any passenger, nor for any loss or damage or delay to passenger's property whether such loss of life, loss, injury, delay, inconvenience, deficiency in service, expense or damages arises from the act, default, neglect or error of judgment of the carrier, its agents, employees, Captain, crew or other employee of the carrier or any person whatsoever associated in whatever manner with the operation of the vessel or from or consequent upon un-seaworthiness or unfitness of the vessel or any launch, tender or other craft or gangway, land stage or land conveyance used in connection therewith or from the unfitness of any food or drink supplied to the passengers or from or consequent any detention, delay, deviation, over carriage or omission to call or land or embark passengers or passenger's property at any place or from or consequent on any variation or omission of any part of the advertised programme of the voyage or otherwise howsoever and whether such act, default, neglect, error of judgment, un-seaworthiness, unfitness, detention, or after disembarkation at the end of the voyage or during any conveyance pursuant thereto or while the passenger is proceeding from the vessel to the shore or vice versa or is ashore which may take place during or in connection with the voyage or at any time whatsoever after or prior to the voyage when the carrier might, apart from this clause, be under a contractual, statutory or any other obligation whatsoever to the passenger.
    • All the foregoing exemption from liability shall apply equally to any ancillary contract of service, whether gratuitous or otherwise, (whether for consumption or otherwise), and the provision of medical care of whatever nature carried out or provided during or in connection with the performance of the carrier's obligation to the passengers.
  • EXEMPTION OF EMPLOYEES, AGENTS, ETC, FROM LIABILITY
    No employee or agent of the carrier nor any operator of the vessel nor any independent contractor from time to time employed by the carrier, shall in any circumstances whatsoever be under any liability whatsoever to the passenger for the death, sickness, injury, loss, damage, delay or otherwise of or to the passenger, his property, here of arising or resulting directly from any act, neglect or default on the part of such employee, operator, or independent contractor while acting in the course of or connected in any way with his employment, agency, or contractual liability to the carrier and every condition, limitation exception and liberty herein contained and every right, exemption liability, defence, immunity of whatsoever nature applicable to the carrier shall also be available and extend to protect every such employee, agent, operator and independent contractor of the carrier acting as aforesaid and for all the purposes of the foregoing clauses of this clause, the carrier is contracting with the passenger as agent of and trustee for such employees, agents, operators and independent contractors who are deemed to be parties to the contracted conveyance of passengers. Such exemption shall, without derogating from the generality thereof, extend to anything which such persons shall do with regard to the operation, repair or servicing of the vessel and the provision of any service on or in connection with the operation of the vessel however remote such activity shall be.
  • PASSENGERS LIABILITY TO INDEMNIFY CARRIER
    No employee or agent of the carrier nor any operator of the vessel nor any independent contractor from time to time employed by the carrier, shall in any circumstances whatsoever be under any liability whatsoever to the passenger for the death, sickness, injury, loss, damage, delay or otherwise of or to the passenger, his property, here of arising or resulting directly from any act, neglect or default on the part of such employee, operator, or independent contractor while acting in the course of or connected in any way with his employment, agency, or contractual liability to the carrier and every condition, limitation exception and liberty herein contained and every right, exemption liability, defence, immunity of whatsoever nature applicable to the carrier shall also be available and extend to protect every such employee, agent, operator and independent contractor of the carrier acting as aforesaid and for all the purposes of the foregoing clauses of this clause, the carrier is contracting with the passenger as agent of and trustee for such employees, agents, operators and independent contractors who are deemed to be parties to the contracted conveyance of passengers. Such exemption shall, without derogating from the generality thereof, extend to anything which such persons shall do with regard to the operation, repair or servicing of the vessel and the provision of any service on or in connection with the operation of the vessel however remote such activity shall be.
  • LIMITING CARRIER'S LIABILITY
    The Carrier shall be entitled to limit his liability in accordance with the Athens Convention and/or any other applicable international convention concerning the limitation of liability for multiple claims. In no circumstances shall the Carrier be liable for damage, loss or expense suffered as a result of delay howsoever caused, or for any loss, damage existing outside the scope of application of the contract of carriage.
  • LIABILITY OF CARRIER'S EMPLOYEES, AGENTS AND INDEPENDENT CONTRACTORS - PROTECTED PERSON
    By accepting carriage on these conditions, the Passenger shall be deemed to offer to the Carrier, as agent for any Protected Person, the benefit of every exemption from and limitation of liability, and for every defense or immunity from claims, provided for the benefit of the Carrier under these conditions of carriage and/or applicable provision of law and/or the Athens Convention, and the Carriers acceptance of such offer shall be deemed to be ratified severally by the Protected Person (whether or not he has actual knowledge of the terms of the offer) upon his providing and facility or service, whether or not the passenger has notice thereof; the consideration for such offer and for any contract made pursuant thereto shall be provision or prospective provision by any Protected Person of any facility or service for the benefit, whether direct or in direct amounts recoverable from the Carrier and any Protected Person shall in no case exceed the limits provided by the contract of carriage and/or any applicable provision of law/or the Athens Convention.
ARTICLE 16 - LAW AND JURISDICTION
Any dispute arising under this contract shall be determined in the Emirate of Abu Dhabi in accordance with the laws of United Arab Emirates as applied in the Emirate of Abu Dhabi and all passengers submit to the jurisdiction of the courts of the Emirate of Abu Dhabi in respect of any dispute arising under the Terms and Conditions of Carriage. Each of the parties to these Terms and Conditions of Carriage hereby irrevocably and unconditionally:
  • consents to submit to the exclusive jurisdiction of the courts of Emirates of Abu Dhabi, United Arab Emirates for any proceeding arising in connection with these Terms and Conditions of Carriage and each such party agrees not to commence any such proceeding except in such courts, and
  • waives any objection to the laying of venue of any such proceeding in the courts of Emirates of Abu Dhabi, United Arab Emirates.
ARTICLE 17 - DISCLAIMER
No agency, member of staff or representative of the Carrier is authorised to change or make a disclaimer regarding the present Terms and Conditions of Carriage.
ARTICLE 18 - PRIVACY
The privacy of the Passenger is of utmost importance to the Carrier and the Carrier shall acts in the most meticulous manner to protect personal data that belongs to the Carrier's clients. By visiting our webpage and/or using online services you agree to terms listed below:

ARTICLE 19 - GENERAL
  • Waiver: Any waiver by carrier of a breach of any provision of this Terms and Conditions of Carriage shall not operate as or be construed to be a waiver of any other breach of such provision or of any breach of any other provision of this Terms and Conditions of Carriage.
  • Modifications: No revision or modification of this Terms and Conditions of Carriage shall be effective unless in writing and executed by authorized representative of the Carrier.
  • Severability: If any portion of these Terms and Conditions of Carriage is held invalid, such invalidity shall not affect the validity of the remaining portions of the Terms and Conditions, and the parties will substitute for any such invalid portion hereof a provision which best approximates the effect and intent of the invalid provision.
  • Headings: The paragraph titles of this Terms and Conditions of Carriage are for convenience only and shall not define or limit any of the provisions hereof.
ARTICLE 20 - CHANGES
Carrier is entitled to change these carriage conditions partly or wholly as and when it deems necessary.
ARTICLE 21 - SUPERCEDE ALL OTHER CONDITIONS
These Conditions of carriage shall supercede all other Terms and Conditions of Carriage issued prior.
